PROCEDURAL PROCEDURE FOR ELECTION OF PREVENTIVE MEASURES IN THE FORM OF A PROHIBITION OF CERTAIN ACTIONS: CURRENT STATE AND PROBLEMS

Annotation. The article analyzes the procedural order of a new preventive measure for the Russian criminal process — the prohibition of certain actions. The authors compare the procedural order of choosing this measure of restraint with the order of choosing detention and house arrest. Noting the rarity of the application in practice of the prohibition of certain actions, the authors point to the existing objective difficulties in monitoring the observance of the accused of those restrictions and prohibitions that are imposed on him. The article proposes to expand the list of control measures at the disposal of criminal executive inspectorates, to empower them to carry out operational-search measures aimed at monitoring the accused, suspects; expand the technical base to ensure control over the accused. The article also proposes to expand the court’s capabilities to establish restrictions on the activities of the accused. Currently, the court has the right to prohibit only driving. The authors subscribe to the proposal previously expressed in the scientific literature on the need to empower the judge with the right to prohibit the accused (suspect) and other activities in order to prevent the commission of new crimes.
