ETHICAL CONFLICTS OF HUMAN RIGHTS PROTECTION: PERSONALITY DEVELOPMENT STRATEGIES AND NORMATIVITY[2]

Annotation. Human rights are an undoubted achievement in the development of modern society. The universal moral principles of freedom, personal inviolability, respect, cooperation, which are declared at the international level as the basis for civilized interaction, are provided by regulatory mechanisms that regulate all spheres of public relations. Ethical values are fixed in the form of human rights and related to the individual as the ultimate goal of social development. However, in practice, the protection of human rights, in addition to focusing on creating conditions for self-development and self-realization of the individual, acquires a dogmatic character and is expressed in a system of categorical prescriptions about when, how and whose rights should be protected. There are ethical conflicts that are caused by distancing moral values and judgments from the moral act. The dominant feature of modern strategies for human development is the right to evaluate what is happening from the standpoint of a personal understanding of morality and moral experience, without taking into account personal responsibility for what is happening. The analysis of ethical conflicts of human rights allows us to answer the questions about how the attitude towards value and normative systems is changing, where antagonism arises in the interaction of moral and legal regulators.
