THE HISTORY OF DEVELOPMENT AND THE CURRENT STATE OF THE INSTITUTE OF SOCIAL AND LEGAL REGULATION OF THE IMPLEMENTATION OF THE CHILD’S RIGHT TO EXPRESS ITS OPINION IN RUSSIA

Annotation. This article examines and analyzes issues related to the history of the development of the institution of the realization of the child’s right to express his personal opinion and its current state, within the framework of the norms of Russian and international law.
The purpose of this work is to analyze the history, regulatory framework and research of scientists in order to identify urgent problems in the current law enforcement practice. The relevance of this study is due to a number of problems arising in judicial practice, as well as the actively shortening period of growing up of a modern child. The work was done through the use of historical and legal, logical and comparative legal research methods.
This work provides data from research by psychologists, teachers, as well as the opinions of a number of scientists in the field of family law.
The article also draws attention to family relations, which in turn fall under the regulation of not only legal norms, but also the norms of morality and ethics, which are in close interaction with each other.
Having analyzed the norms of international and national legislation that regulate the question of the child’s expression of his opinion, the authors have made recommendations for improving the current family legislation.
