CURRENT PROBLEMS OF REALIZATION OF THE RIGHT OF THE ACCUSED, SUSPECTED FOR DEFENSE

The article considers a number of topical problems of the implementation of the right of the accused, the suspect to defense in criminal proceedings. The study of the problem of «double protection» showed that at present the issues of the grounds and procedure for the entry into the case of «understudy lawyers» are not adequately regulated by law. In fact, the activities of the participants in the criminal process in this area should be built in accordance with the explanations of the highest bodies of the judiciary and the lawyers’ community, which raises the question of the need for additional legislative regulation in those articles of the Code of Criminal Procedure of the Russian Federation that regulate the procedure and grounds for the appointment of an appointed lawyer. At present, the bodies of the legal community require from “understudy lawyers” to check the legality and validity of the procedural decision by which he was appointed in accordance with Art. 50, 51 of the Code of Criminal Procedure of the Russian Federation, the presence of specific factual circumstances indicating the bad faith of the behavior of the defender by agreement or the suspect, the accused. A lawyer who establishes that his appointment was carried out in violation of the requirements of the law and in violation of the right to defense is obliged to make an official statement to the court (investigator) about this and withdraw from participation in the proceedings. The article also substantiates the need to create additional guarantees that protect the accused from unreasonable restrictions on his rights when he is kept in a pre-trial detention center, the introduction of additional regulation of the procedure and grounds for granting visits to the accused, the suspect. The author believes that when regulating this area, it is necessary to take into account that isolation from society in a pre-trial detention center should be carried out in accordance with the objectives of the preventive measure arising from Art. 97 Code of Criminal Procedure of the Russian Federation. It is necessary to create reliable guarantees for the preservation of family relations of the accused, the suspect, any restrictions on visits with relatives and friends must be justified by specific factual circumstances and subject to real judicial control. The article proposes a number of additions to Art. 18 of the Federal Law of July 15, 1995 No. 103-FZ «On the detention of suspects and accused of committing crimes».
