SOME PROBLEMS OF THE COURT’S PARTICIPATION IN PROVING CRIMINAL CASES<\/strong><\/p>\n\n\n\n

The article is devoted to the study of the most important and understudied problematic issues of the court’s affiliation with the process of proof. Various points of view regarding the reference of the court to the subjects of proof are considered.<\/p>\n\n\n\n

Special attention is paid to the issues of the court’s participation in the proving at the pre-trial stages of the criminal procedure. It is proposed to clarify the powers of the court to authorize the seizure of documents and items containing legally protected secrets.<\/p>\n\n\n\n

Also the article presents the features of proof are considered when the court considers complaints during pre-trial proceedings in a criminal case. Attention is drawn to the problem of the participation of the court in proving in the time of lodging of judicial appeals about withdraw from criminal prosecution. The contradictory judicial practice on this issue is analyzed. It is proposed to improve the provisions affecting the participation of the court in proving when appealing a discontinued criminal case.<\/p>\n\n\n\n

The issue of collecting evidence by the court on its own initiative was raised in the article. The case law on issue of appointing a forensic enquiry and an investigative experiment at the discretion of the court has been studied. It is proposed to improve the procedure and grounds for conducting an investigative experiment in a court session. The attitude of the court as a subject of a proof duty is analyzed. The problems of expanding the powers of the court to collect evidence are considered and conclusions are drawn about the role of the court in the adversarial criminal procedure.<\/p>\n\n\n\n
