THE PROBLEM OF ABORTION IN ORTHODOX CANON LAW

The purpose of the article is to consider the attitude of Orthodox canon law to the problem of abortion. The author traces the historical conditions of the formation of views on abortion in the epoch of Antiquity on the example of the philosophy of Aristotle and the Digest of Justinian. The main traditions on the basis of which the position of the opponents of abortion was formed (medical ethics, conservative and Christian morality) are singled out. It is shown that Christian thinkers unlike others equated abortion with murder, that is, they condemned this action as such, and not just its consequences. The formation of a position according to which the beginning of human life starts at the moment of conception is demonstrated. The canonical grounds for church punishment for abortion are described. On those who committed it, penance was initially imposed as for murder, i.e. excommunication until the end of life, later — ten-, five- or three-year excommunication, which could be reduced in case of sincere penitence. By the end of the 20th century, abortion had become a serious social problem. In the discussions about abortion, religion supports the traditional position. Its justification faces difficulties, the cause of which is the impossibility of applying the pan-Orthodox canons, adopted more than a thousand years ago, to the present day situation. The solution to the problem is the application of the principle of oeconomy, according to which healing should, according to Basil the Great, “be measured not by time, but by the way of repentance.” Specific guidelines for the application of the canons are provided by new regulatory documents of the Orthodox Church.
