CURRENT PROBLEMS OF PREPARATION OF A CRIMINAL CASE FOR A COURT SESSION HELD IN THE ORDER OF CHAPTER 40 OF THE CODE OF CRIMINAL PROCEDURE OF THE RUSSIAN FEDERATION

The article deals with a number of topical problems that arise at the stage of preparation for a court hearing in a criminal case, where the defendants filed a petition for the application of a special procedure for the trial. In particular, the inconsistency of the legislation was revealed in terms of the name of the petition filed by the accused when familiarizing himself with the materials of the criminal case or at the preliminary hearing: in paragraph 2 of part 5 of Art. 217 of the Code of Criminal Procedure of the Russian Federation, it is referred to as “a petition for the application of a special procedure for trial”, and in part 1 of Art. 315 of the Code of Criminal Procedure of the Russian Federation — “a petition for a sentence without a trial in connection with agreement with the charge”. Comparison of these names with the procedure for the proceedings in the order of Ch. 40 of the Code of Criminal Procedure of the Russian Federation made it possible to identify the shortcomings of both formulations. The author proposes in both articles to use the following name of the petition — a petition for the application of a special procedure for the trial, provided for in Ch. 40 Code of Criminal Procedure of the Russian Federation.

An analysis of the current legislation and the practice of its application led to the conclusion that in modern criminal procedural law and the established practice of its application, in preparation for the trial, a petition for the application of a special procedure for trial, provided for in Chapter 40 of the Code of Criminal Procedure of the Russian Federation, should be considered on the basis of an incomplete analysis of the entire range of grounds and conditions for a special order of trial: even in the case of a preliminary hearing, the court only takes into account the right of the accused to petition for a special procedure, taking into account the category of crime (minor and medium gravity). A full check of the entire range of grounds for the application of a special procedure for making a court decision in the order of Ch. 40 of the Code of Criminal Procedure of the Russian Federation is carried out in the preparatory part of the trial with the participation of the defendant, defense counsel, victim and public prosecutor. The author proposes to allow the judge in a situation where a preliminary hearing is scheduled, already in this court session, to establish all the provisions of Art. 314, 315 of the Code of Criminal Procedure of the Russian Federation, the grounds and conditions for the application of a special procedure for judicial proceedings.
