PROBLEMS OF CRIMINAL LEGAL COUNTERACTION TO A KNOWN FALSE REPORT ON AN ACT OF TERRORISM

The article considers a number of topical problems that arise in the application of the institution of criminal liability for knowingly false reporting of an act of terrorism. Substantiating the relevance of improving criminal law measures to counteract these crimes, the authors draw attention to their prevalence and significant harm to society and the state, especially from waves of telephone terrorism coordinated by criminal groups located outside the Russian Federation, which require the efforts of many emergency services, distract them from the performance of professional duties and entail significant costs for public and private organizations.

The study led to the conclusion that a deliberately false report about an act of terrorism should be classified as a terrorist crime if it is committed in order to obstruct the activities of government bodies, influence these bodies, intimidate the population, i.e. Parts 3 and 4 of Article 207 of the Criminal Code of the Russian Federation in all cases, and parts 1 and 2 of Article 207 of the Criminal Code of the Russian Federation, depending on the criminal motive. This will correspond to the concept of terrorism from paragraph 1 of Article 3 of the Federal Law «On Combating Terrorism».

The authors also propose, when developing a methodology for the activities of law enforcement agencies to check reports of terrorist attacks, to take into account the signs that indicate deliberately false messages (the use of foreign IP addresses and telephone numbers, the mass and stereotyped nature of messages, the lack of results when checking the first messages). The presence of several signs from among the above at once should allow the heads of the bodies that check these messages, taking into account the specifics of a particular situation, to make decisions on conducting checks without evacuating citizens in order to prevent the achievement of the goals of such attacks by «telephone terrorists».

In addition, the authors, based on the established judicial practice, propose to exclude from Part 1 of Article 270 of the Criminal Code of the Russian Federation the phrase «committed from hooligan motives.» This will re-criminalize any deliberately false reports of terrorist attacks, regardless of the perpetrator’s motives, and will return judicial and investigative practice to the «classic» understanding of hooligan motives.
