SEPARATE PROBLEMS OF THE IMPLEMENTATION OF HUMAN RIGHTS GUARANTEES IN THE APPLICATION OF COERCIVE MEASURES IN CRIMINAL PROCEEDINGS

The article deals with the issues of ensuring human rights in the event of a person being detained on suspicion of committing a crime and choosing a measure of restraint in relation to the suspected person in the form of remand in custody. Issues of validity and proof of the grounds for the remand in custody of the suspect and the accused, the beginning and correct calculation of the period of detention of a person on suspicion of committing a crime remain problematic. An analysis of the current legislation and the practice of its application led to the conclusion that the grounds for remand in custody must be substantiated by relevant, admissible and reliable evidence.

Attention is drawn to the absence in the law of a clear regulation of the timing and sequence of actions of officials at the stage of delivering a suspected person. In the criminal procedural literature there are attempts to justify the need to count the time of detention from the moment of delivery to the investigator. The legislator distinguishes between actual and legal (with the preparation of a protocol) detention, the first of which (actual detention and delivery to the investigator) may well be allowed before a decision is made to initiate a criminal case. Therefore, it is proposed to legislatively unify the concept of the actual detention of a person on suspicion of committing a crime.
