THE EVOLUTION OF THE WESTERN EUROPE CANONICAL LAW DURING THE PRE-GRATSIAN PERIOD: COMPREHENSION OF THE NEED TO SYSTEMATIZATION

In this article, the author discusses the possibility of a phased detailing of the pre-Gratian period in the development of canon law. A detailed analysis of the era allows us to conclude that the two systems – Roman law and canon law – are constantly interacting and mutually influencing. This mutual influence had a strong impact on the formation of the Church’s desire for a full-fledged systematization of norms by analogy with the Code of Justinian.

As a result of the application of extensive methodological tools, it has been established that already in the pre-Gratian era, a constant trend in the development of canon law is formed: this is the desire for codification. If we talk in a broad sense about the codification of law in the sense of grouping various laws, then we can say that it was present in canon law from the very beginning of its existence, and the approach outlined in the text of the article to highlight the stages of development of canon law in the pre-Gratian period clearly demonstrates this.
