PROHIBITION OF CERTAIN ACTIONS IN CRIMINAL PROCEEDINGS: PROBLEMS OF LEGAL REGULATION AND PRACTICE

The article considers a number of topical problems of the prohibition of certain actions as a new measure of restraint in the Russian criminal process.

The first problem is due to the fact that the list of prohibitions is formulated in such wording that they exclude broad interpretation, which limits the scope of this preventive measure. The author proposes to expand the list of prohibitions: to leave the municipality where the accused (suspect) lives without the permission of the interrogating officer, investigator or court; prohibition of consumption (drinking) of alcoholic products; prohibition of the implementation of any activity in which the crime was committed.

The second problem is related to the lack of clear differences between the prohibition of certain actions and house arrest in terms of restricting the freedom of movement of the accused or suspect. The practice of applying both preventive measures allows for the imposition of the same prohibitions.

Inextricably linked with this problem is the problem of developing a fair mechanism for recalculating the days of execution of these preventive measures into the term of detention and, accordingly, the term of imprisonment, if it is appointed by a court verdict. The author proposes to additionally regulate the rules for choosing these preventive measures. Firstly, it is necessary to introduce a clear legislative ban on establishing any walks during house arrest (with certain exceptions). House arrest should ensure isolation from society, with the exception of communication with persons living with the accused, authorized participants in legal proceedings and other persons established by law. The rules for recalculating such house arrest should be retained as 2 days to 1 day of detention. Secondly, the prohibition of certain actions as a milder measure of restraint should already, as it is today, provide for the possibility of flexible (taking into account the emerging investigative situation, the behavior of the accused, the suspect and other circumstances) the duration of his free movement in public places, including to buy food. Such a measure of restraint should already provide for other rules for recalculation: 3 days of prohibition for 1 day of detention.
