The author gives an overview of the positions of modern scientists on the need to reduce or increase the range of investigative actions requiring judicial authorization. The classification of investigative actions is carried out depending on the presence or absence of constitutional norms requiring preliminary judicial authorization. The author points out the existence of conflicts in the legal regulation of judicial authorization of investigative actions against a lawyer, contradictions in the norms of the Criminal Procedure Code of the Russian Federation and the Federal Law “On Advocacy and the Bar in the Russian Federation” are revealed, the peculiarities of the legal positions of the Constitutional Court of the Russian Federation on this issue are highlighted.

The author proposes to exclude from Part 1 of Article 450.1 of the Criminal Procedure Code of the Russian Federation a mandatory condition for conducting a search, inspection and seizure against a lawyer – the presence of a criminal case initiated against him or the involvement of a lawyer as an accused. Taking into account the existence in the current legislation of additional guarantees for the protection of attorney-client privilege and ensuring legality in the production of these investigative actions in the form of preliminary judicial control, the presence of a representative of the Chamber of Advocates of the subject of the Russian Federation, the condition under consideration for the production of investigative actions seems excessive and hinders the achievement of the goals of criminal proceedings.

In relation to other investigative actions not specified in Article 450.1 of the Code of Criminal Procedure of the Russian Federation, the Code should be supplemented by the norm on preliminary judicial control over investigative actions and the inextricably linked to it by the compelling appearance of a lawyer on the case of his principal. It is important to protect the lawyer from such unscrupulous means of withdrawal of the lawyer-defender from the case of his principal, which are used in practice by some investigators, interrogators.

If investigative actions are carried out against a lawyer in other criminal cases, including those initiated against them, providing them with additional guarantees in the form of preliminary judicial control is unreasonable, since it is at odds with the requirements of the principle of equality before the law and the court.

Keywords: judicial control, judicial authorization, court, investigative action, search, seizure, inspection, interrogation, lawyer, defender
