THE STAGE OF PREPARATION FOR THE COURT SESSION DURING THE JUDICIAL CONTROL PROCEEDINGS IN ACCORDANCE WITH ARTICLE 165 OF THE CODE OF CRIMINAL PROCEDURE OF THE RUSSIAN FEDERATION

The article is devoted to the analysis of current problems of legal regulation of judicial control carried out in accordance with Article 165 of the Code of Criminal Procedure of the Russian Federation, which, as judicial statistics show, is in demand in practice and shows an upward trend.

The author identifies three independent stages of judicial control in accordance with Article 165 of the Code of Criminal Procedure of the Russian Federation. The first is initiation by a person conducting criminal proceedings of a petition for investigative action by issuing an appropriate resolution. The second is preparation for a court hearing, including the reception and registration of the above-mentioned resolution-petition by the court apparatus, its distribution to a specific judge and performing other preparatory actions for the court hearing to consider the above-mentioned petition. The third is a court session with the participation of the prosecutor, investigator (inquirer) and other persons authorized by law, ending with the issuance of a court order.

Based on the analysis of legislation and legal positions of the Plenum of the Supreme Court of the Russian Federation, the author substantiates the conclusion that the preparation for the court session is an independent stage of judicial control proceedings in accordance with Article 165 of the Code of Criminal Procedure of the Russian Federation, which has a number features. A certain range of issues are considered and resolved at this stage. The judge at this stage, having no right to consider the resolution-petition on its merits, is endowed with a set of control and preparatory powers that allow creating optimal conditions for the prompt consideration of the received resolution-petition. Employees of the court staff are also endowed with special powers to receive, register the resolution-petition, distribute it to a specific judge and perform other preparatory actions for the trial a meeting to consider the above-mentioned petition). A special range of decisions made at this stage, etc.

The importance of the stage of preparation for the court session within the framework of judicial control proceedings in accordance with Article 165 of the Code of Criminal Procedure of the Russian Federation necessitates detailed legal regulation in the Code of Criminal Procedure of the actions of the judge, the court staff at this stage and the elimination of existing gaps in criminal procedure legislation.

The article proposes to clarify the wording of the powers of the court in the exercise of control in accordance with Article 165 of the Code of Criminal Procedure of the Russian Federation. Since, within the framework of this judicial control procedure, the investigator acts as the initiator of the investigative action, and the court as the subject authorizing the investigative action (Part 1, 4 of Article 165 of the Code of Criminal Procedure of the Russian Federation), the wording of Article 29 of the Code of Criminal Procedure of the Russian Federation must be brought in accordance with the above norm: in paragraphs 4, 5, 5.1, 5.2, 6, 7, 8, 11, 12 h. 1 art. 29 of the Code of Criminal Procedure of the Russian Federation should indicate that the exclusive powers of the court include making a decision «on authorizing the production» of the relevant investigative action.
