PROBLEMS OF LEGAL REGULATION OF JURISDICTION IN CONSIDERING PETITIONS FOR INVESTIGATIVE AND OTHER PROCEDURAL ACTIONS FILED IN ACCORDANCE WITH ARTICLE 165 OF THE CODE OF CRIMINAL PROCEDURE OF THE RUSSIAN FEDERATION

The article considers a number of theoretical and practical problems related to the legal regulation of the jurisdiction of petitions submitted in accordance with Article 165 of the Code of Criminal Procedure of the Russian Federation for the production of investigative and other procedural actions requiring judicial authorization. The author gives an overview of the positions of the Constitutional Court of the Russian Federation, modern scientists on the concept of jurisdiction and the applicability of this term to the definition of a competent court in the pre-trial stages of criminal proceedings and the stages following the proceedings in the court of first instance. The article substantiates a broad approach to understanding jurisdiction in criminal proceedings as an independent institution of criminal procedural law and the system of criminal procedural norms established by the norms of this institution, regulating, firstly, the order of distribution between courts (judges) of general jurisdiction of various categories of cases to be considered and resolved at all stages of the criminal process, secondly, the criteria for the distribution of cases (signs, types of jurisdiction) between courts (judges).

The article considers the problem of the absence in the Code of Criminal Procedure of the Russian Federation of norms regulating jurisdiction and, in general, the procedure for resolving by the court the question of whether there are grounds for permission to exhume in the absence of consent of the deceased’s relatives to this procedural action. To eliminate this gap, the author proposes to fix in Part 2 of Article 29 of the CPC of the Russian Federation the authority of the court to grant permission for exhumation in the absence of consent of close relatives and relatives of the deceased, and part 1 of Article 165 of the CPC of the Russian Federation add a reference to the above paragraph of Part 1 of Article 29 of the CPC of the Russian Federation.

The author also analyzes the shortcomings of the legal regulation of the rules of delimitation of jurisdiction between the district and garrison military courts when considering petitions for investigative actions. The article suggests in part 2 of art. 165 of the Code of Criminal Procedure of the Russian Federation to fix the norm that this petition is subject to consideration solely by a judge of the garrison military court, if it is initiated by an official of the body of inquiry in the Armed Forces of the Russian Federation, other troops, military formations and bodies in which military service is provided, military investigative bodies in cases under the jurisdiction of military courts, or solely by a judge of the district court, if the petition is initiated by officials of other bodies of preliminary investigation.
