PROBLEMS OF LEGAL REGULATION OF APPLICATION AND CANCELLATION OF THE MEASURE OF PROCEDURAL COERCION IN THE FORM OF SEIZURE OF PROPERTY

The article considers a number of topical problems that arise at the stages of application and cancellation of the measure of procedural coercion in the form of putting the property under arrest. The relevance of studying the institution of seizure of property is substantiated by statistical data indicating the prevalence of the practice of applying this measure of coercion. The authors also draw attention to numerous changes in recent years in the procedure for choosing and canceling seizure of property, the differentiation of the procedure, which currently provides for both prior and subsequent judicial control over its legality and validity.

The conducted study allowed us to conclude that the procedure for pre-trial seizure of property by order of the investigator (inquiry officer) provided for in Part 5 of Article 165 of the Criminal Procedure Code of the Russian Federation has a narrow scope of application: it protects only public interests related to foreclosure on property subject to confiscation and specified in Part 1 of Article 104.1 of the Criminal Code of the Russian Federation. The authors believe that public interests related to the execution of fines and other property penalties, as well as the interests of victims, civil plaintiffs in the recovery of damages caused by a crime, and amounts of compensation for moral damage, remain without due protection.

An analysis of similar institutions in a number of foreign states shows that the pre-trial procedure does not have similar restrictions and can be introduced in exceptional cases to ensure all property payments, penalties, and punishments that may threaten the accused. The authors propose excluding from Part 5 of Article 165 the phrase “specified in Part One of Article 104.1 of the Criminal Code of the Russian Federation”, which will allow, in exceptional cases that cannot be delayed, to seize property on any of the grounds provided for in Article 115 of the Criminal Procedure Code of the Russian Federation.

Also, when analyzing judicial practice, a coordinated position of the Supreme and Constitutional Courts of the Russian Federation was revealed that the expiration of the property seizure period, as well as the court’s decision to refuse the investigator to extend the seizure of property, is not an independent basis for lifting the seizure. In some cases, even a year after the expiration of the property seizure period, the body registering property rights refuses to lift the restrictions and register transactions with property whose seizure periods have expired. The courts consider the only basis for lifting the seizure of property to be the issuance of a ruling by the investigator (inquiry officer) to lift the seizure. At the same time, the law does not provide for clear deadlines for making such a decision, which leads to abuses by officials and violations of the rights of participants in the proceedings.

To solve the above problem, the authors propose to enshrine in Part 9 of Article 115 of the Criminal Procedure Code of the Russian Federation a norm on the mandatory issuance by the investigator (inquiry officer) of a ruling to cancel the seizure of property within 24 hours from the occurrence of the following circumstances: expiration of the seizure period of property, entry into force of a court decision to refuse to extend the seizure period.
