FEATURES OF JUDICIAL CONTROL AT PRE-TRIAL STAGES OF CRIMINAL PROCEEDINGS

The recent introduction and expansion of judicial review at the pre-trial stages of criminal proceedings in modern Russia has renewed interest in its theoretical foundations. This article summarizes the main types of judicial review at pre-trial stages of criminal proceedings and identifies five common features.

Firstly, judicial review is a guarantee, first of all, of constitutional rights and freedoms of the individual from illegal and unreasonable restriction or violation by bodies and officials carrying out criminal prosecution.

Secondly, judicial review has a limited subject of verification; it is selective and does not extend to the appropriateness or effectiveness of the procedural activities of the bodies and officials being inspected, as well as those aspects of the procedural activities that do not limit the constitutional rights and freedoms of the individual.

Thirdly, judicial review is passive in nature, because courts cannot initiate control procedures on their own nor expand its subject matter.

Fourthly, judicial review has limited forms of response by the court to identified violations of the constitutional rights and freedoms of participants in criminal proceedings. Courts lack administrative or disciplinary powers in relation to the bodies and officials carrying out criminal prosecution; the court has no right to impose on them any duties in the sphere of their criminal procedural or operational-investigative activities (except for the duties stipulated by law to eliminate the violation identified by the court), give them instructions, apply disciplinary measures or other sanctions, with the exception of one of the following procedural sanctions: refusal to satisfy a petition for the performance of a procedural action or the application of a measure of procedural coercion that restricts the constitutional rights of a person, recognition of a decision, action (inaction) of a body, official as illegal and (or) unfounded; issuance of a private ruling (determination).

Fifthly, judicial review does not imply pre-determining any issues that may become the subject of judicial proceedings.
