PROBLEMS OF LEGAL REGULATION OF THE LIMITS OF COURT ACTIVITY WHEN CONSIDERING A COMPLAINT UNDER ARTICLE 125 OF THE CRIMINAL PROCEDURE CODE OF THE RUSSIAN FEDERATION

This article addresses the problems of legal regulation of the limits of court activity when considering complaints against decisions, actions (inaction) of bodies and officials conducting criminal prosecution in accordance with Article 125 of the Criminal Procedure Code of the Russian Federation. The author concludes that this type of judicial review is characterized by the court’s passivity: the court initiates review only in response to appeals filed by authorized persons, and the subject of review is limited to what those persons indicate. With regard to the procedure for considering a complaint in accordance with Article 125 of the Criminal Procedure Code of the Russian Federation, this means that the court must check the decisions, actions (inaction) for illegality or groundlessness indicated by the applicant.

The author believes that the issue of whether the court has the right to go beyond the arguments of the complaint when assessing the legality and validity of decisions, actions (inactions) is insufficiently regulated in the legislation and explanations of the Plenum of the Supreme Court of the Russian Federation. An analysis of judicial practice shows that courts, as a rule, do not go beyond the arguments of the complaint. Decisions in which higher courts recognize an incomplete verification of the legality and validity of the contested decisions as a violation of the criminal procedure law are isolated.

To address this gap, the article proposes an analogy with the procedure under Article 226 of the Code of Administrative Procedure of the Russian Federation. Under this approach, courts would be required to assess not only the claims raised in the complaint, but also the legality of the contested decision in its entirety. It is also important to regulate the issues of distribution of the burden of proof: the legality and validity of the contested decision must be proven by the official who made it; the existence of violations of constitutional rights must be proven by the person who filed the complaint.
