PROBLEMS OF LEGAL REGULATION OF THE SUBJECT OF JUDICIAL REVIEW OF INVESTIGATIVE ACTIONS UNDER ARTICLE 165 OF THE CRIMINAL PROCEDURE CODE OF THE RUSSIAN FEDERATION<\/strong><\/p>\n\n\n\n

This article examines the problem of interpreting the term «investigative action» as used in Article 165 of the Criminal Procedure Code of the Russian Federation to define the subject of this type of judicial review. The author, noting the inconsistency in the interpretation of this term in current criminal procedure legislation, analyzes approaches to understanding the concept and types of investigative actions established in Soviet and modern scientific literature. The paper characterizes the positions of proponents of «broad» and «narrow» approaches to interpreting the term «investigative action.» The author concludes that the practical meaning of this term, like other terms in a state governed by the rule of law, should be clearly and uniformly understood by all participants in criminal procedural relations. The author proposes to enshrine the following definition in the law: «An investigative action is a procedural action provided for by criminal procedure law, carried out in pre-trial proceedings by persons authorized by law for the purpose of collecting and\/or verifying evidence to establish circumstances relevant to the criminal case. Investigative actions include: inspection, examination, investigative experiment, search, seizure, seizure of postal and telegraph items, their inspection and seizure, monitoring and recording of conversations, inspection and listening to audio recordings, obtaining information about connections between subscribers and\/or subscriber devices, interrogation, confrontation, identification, on-site verification of testimony, and forensic examination.»<\/p>\n\n\n\n

It is also proposed to bring the Criminal Procedure Code of the Russian Federation into conformity with this definition, including the provisions regulating the subject of judicial review in Article 165 of the Code. In particular, in the title and Parts 1\u20133, 4, and 5 of Article 165, the term «investigative action» should be replaced with «investigative and other procedural action.» In Section 3.1, «investigative action» must be replaced with «procedural action,» since the actions of the investigator or inquiry officer regarding the sale, disposal, or destruction of evidence stipulated by this section are not related to the collection and verification of evidence.<\/p>\n\n\n\n
