SPECIFIC FEATURES OF IMPLEMENTING THE ADVERSARIAL PRINCIPLE IN JUDICIAL CONTROL OF INVESTIGATIVE ACTIONS UNDER ARTICLE 165 OF THE CRIMINAL PROCEDURE CODE OF THE RUSSIAN FEDERATION

This article examines the implementation of the adversarial principle in judicial control proceedings conducted at pre-trial stages under Article 165 of the Criminal Procedure Code of the Russian Federation. The author challenges the widespread position in the academic literature that this principle is inapplicable to preliminary judicial control proceedings.

The study demonstrates that the adversarial principle applies to proceedings under Article 165 of the Criminal Procedure Code, though it possesses unique features. These features stem from the objective impossibility of ensuring the personal participation of the accused, suspect, defense counsel, or other persons subject to investigative and other procedural actions during the preparation and conduct of the court hearing. The fact that the accused or suspect is not informed of the proceedings and the investigator’s planned actions, as well as cannot participate in the hearing does not signify the absence of a legal conflict or dispute in such cases. As in other instances where the legislature cannot ensure the direct participation of interested parties, the preliminary judicial control procedure provides a mechanism for protecting the rights of the absent party through the involvement of specific entities – in this case, the prosecutor.

The criminal procedure legislation imposes on the prosecutor a range of responsibilities to protect the rights and legitimate interests of judicial control proceedings participants, society, and the state. This is achieved by formulating a lawful and well-founded position regarding the existence of grounds for the investigative action and defending it through legal means in courts of first and subsequent instances. The prosecutor is an independent participant with tasks and functions distinct from those of the investigator or other prosecution-side actors. Consequently, the prosecutor may adopt and defend a position contrary to that of the investigator or inquiry officer, which is already a characteristic of modern practice.

The author proposes amending Article 165 of the Criminal Procedure Code of the Russian Federation to establish the mandatory participation of the prosecutor in this type of court hearing.
