PROBLEMS OF LEGAL REGULATION OF PRELIMINARY JUDICIAL REVIEW OF INVESTIGATIVE ACTIONS IN RELATION TO CERTAIN CATEGORIES OF PERSONS<\/strong><\/p>\n\n\n\n

This article examines a range of issues in the legal regulation of judicial review of the legality and validity of investigative and other procedural actions in relation to certain categories of persons, including judges. The author demonstrates the gaps, ambiguities, and inconsistencies in the requirements of criminal procedure legislation and legislation on the status of judges regarding the subjects and procedures for exercising this type of judicial review based on a specific case study. The study resulted in conclusions and proposals aimed at improving the legislation.<\/p>\n\n\n\n

The author proposes eliminating the inconsistencies in the regulation of the procedure for exercising preliminary judicial review of investigative actions in relation to judges and other certain categories of persons, which are present in Article 448 and Part 5 of Article 450 of the Criminal Procedure Code of the Russian Federation. The article proposes to amend Part 5 of Article 450. Firstly, in the Article 450 of the Criminal Procedure Code of the Russian Federation, instead of an ambiguous reference provision, a specific list of entities authorized to submit motions for investigative and other procedural actions with respect to certain categories of persons who do not currently have the status of suspects or accused should be established. Secondly, a list of entities authorized to consider these motions and authorize investigative and other procedural actions should be established. With regard to judges, it is also necessary to eliminate the discrepancies between criminal procedure legislation and legislation on the status of judges regarding obtaining permission to conduct investigative and other procedural actions.<\/p>\n\n\n\n

The author believes that retired judges should be included among persons enjoying special procedural guarantees under Article 447 of the Criminal Procedure Code of the Russian Federation, provided that they do not engage in any activities permitted to them in accordance with legislation on the status of judges.<\/p>\n\n\n\n

Article 165 of the Criminal Procedure Code of the Russian Federation requires more detailed provisions concerning the requirements for an investigator’s motion and the procedure for its resolution in court. Among other things, the responsibilities of the investigator, inquiry officer, and judge related to determining the scope of persons affected by the planned investigative action must be spelled out, in order to determine the need for a special decision-making procedure regarding this investigative action.<\/p>\n\n\n\n

The provisions of Chapters 45.1, 47.1, and 48.1 of the Criminal Procedure Code of the Russian Federation must be brought into line with the specifics of reviewing the legality and validity of interim court decisions made at the request of investigators and inquiry officers. This includes granting investigators and inquiry officers the right to independently challenge interim judicial decisions issued upon their motions. The timeframes for review proceedings must be shortened so that these disputes can be resolved before the criminal case is submitted to court.<\/p>\n\n\n\n
