Factors to increase the level citizens’ confidence to the legislative bodies were found, such as correct exercise of their powers (rulemaking) and compliance with fixed rules of conduct (compliance of the ethics rules). The idea of operating a Code of Ethics for members of rulemaking bodies was proposed. Also the concept of “the parliamentary responsibility” and “the responsibility of parliamentarians” was delimited. On the example of the analyzing of the procedure for drafting laws and also the action of laws such as correction to the Federal law “On counteracting terrorism” and also the law “on fake news”, flaws of the legislature, which minimize the effectiveness of laws was identified. Criteria for assessing the quality of the laws that have entered into force and also list of subjects for the realization of the assessment the quality of the law was proposed. Besides, the idea of attracting members of parliament for non-compliance with these criteria of the law, which entered into force, to the following types of responsibility: administrative, disciplinary, material, moral and also collective constitutional and legal, was advanced. An example of the foreign experience of attracting members of parliament to responsibility for law-making activities, namely the principle of good legislation that operates in the territory of Latvia, was given.

Keywords: parliament, law, draft law, legislature, responsibility, rulemaking, code of ethics, principle of good legislation.

Скачать в PDFСкачать

Читать далее

"_jetpack_memberships_contains_paywalled_content":false
_jetpack_memberships_contains_paid_content":false
[19
5,22
post-709","post","type-post","status-publish","format-standard","hentry","category-nomer1s","tag-1-2019","tag-22
["GET
