PROFESSIONAL WITNESS
IMMUNITY OF ATTORNEY, DEFENDER, MEMBER OF THE FEDERATION COUNCIL, DEPUTY OF THE
STATE DUMA OF THE RUSSIAN FEDERATION IN THE RUSSIAN CRIMINAL PROCESS

The article reveals the content and problems
of legal regulation of professional testimony immunity of a lawyer, advocate,
deputy of the State Duma, a member of the Federation Council of the Federal
Assembly of the Russian Federation. The author, considering the relationship
between the institute of witness immunity of a lawyer, advocate and the norms
of Russian legislation on combating countering terrorism and money laundering,
concludes that a lawyer is obliged to comply with the requirements for identifying
clients and storing documents on transactions (financial transactions) for
which legal assistance was provided , as well as identifying the client, but is
not entitled to testify against his clients in criminal cases. According to the
author, the witness immunity of a deputy of the State Duma, a member of the
Federation Council of the Federal Assembly of the Russian Federation is not
aimed at protecting any secrets protected by law, but at ensuring the
independence of the above-mentioned persons, therefore they have the right to
decide whether to use the institution of immunity or not. The article proposed
to include in paragraph 5 of Part 3 of Art. 56 of the Code of Criminal
Procedure of the Russian Federation, an indication of the deputies of legislative
(representative) bodies of state power of a subject of the Russian Federation
who also have witness immunity.
