PROBLEMS OF LEGAL REGULATION OF THE TRANSLATOR STATUS IN CRIMINAL PROCEEDINGS

Annotation. The article considers a number of urgent problems of the legal status of
an interpreter in criminal proceedings. The author concludes that the right of
the investigator to involve a translator in the case is limited by the
requirements of Art. 37 of the Constitution of the Russian Federation on
freedom of labor and the prohibition of forced labor. Thus, an obligation for a
specific person to participate in the inquiry as a translator can arise only on
the basis of an employment contract (contract) (such translators participate in
the case on the basis of a job assignment) or a civil law contract. Considering
the gaps in the legal regulation of the translator’s remuneration, the author
concludes that detailed regulation of not maximum rates, but specific rates and
methods for calculating the translator’s remuneration, is necessary in the
by-laws. The current legislation, which gives the investigator the right to
independently determine the amount of the interpreter’s payment not higher than
the payment rates determined by the Government of the Russian Federation, can
mislead the participants in the process and is a corruption factor. We believe
that the payment for the services of an interpreter should be regulated in as
much detail as the payment for the work of a defense attorney. The article
proposes to legislatively fix (by analogy with witnesses) that only a person
who has reached the age of majority can be a translator.
