ПРОБЛЕМЫ ПРАВОВОГО РЕГУЛИРОВАНИЯ И ПРАКТИКИ ПРИМЕНЕНИЯ ЗАПРЕТА ВЫХОДИТЬ ЗА ПРЕДЕЛЫ ЖИЛОГО ПОМЕЩЕНИЯ ПРИ ИЗБРАНИИ ЗАПРЕТА ОПРЕДЕЛЕННЫХ ДЕЙСТВИЙ В УГОЛОВНОМ ПРОЦЕССЕ

В статье рассмотрен ряд актуальных проблем применения запрета выходить за пределы жилого помещения при избрании меры пресечения в виде запрета определенных действий (п. 1 ч. 6 ст. 105.1 УПК РФ).

Во-первых, уголовно-процессуальное законодательство и Пленум Верховного Суда РФ не определяют понятие «жилое помещение» применительно к мере пресечения в виде запрета определенных действий. В данном случае по аналогии необходимо применять понятие, закрепленное в ч. 2 ст. 15 Жилищного кодекса РФ.

Во-вторых, проблемой правоприменения является отсутствие практически во всех судебных решениях какого-либо обоснования установления конкретных сроков запрета покидать жилое помещение. Выявленные пробелы в мотивировке решения об избрании запрета определенных действий свидетельствуют об отсутствии реальных оснований для ограничения в данных делах конституционного права обвиняемого на свободу передвижения.

В-третьих, отсутствуют нормы законодательства и разъяснения Пленума Верховного Суда РФ по вопросу о минимальной продолжительности периода свободного передвижения лица, находящегося под мерой пресечения в виде запрета определенных действий. В отсутствие таких норм отдельные судьи считают возможным практически полностью ограничивать свободу передвижения обвиняемых, оставляя 1-2 часа для похода в магазины и для прогулки, что фактически с учетом сложившейся практики приравнивает данную меру пресечения к домашнему аресту. Предлагаем в Постановлении Пленума Верховного Суда РФ разграничить данные меры пресечения, установив, что при запрете определенных действий запрет на свободу передвижения можно ограничить ночным временем или иным периодом не больше 14 часов в день. При этом обвиняемый должен сохранять возможность осуществления трудовой деятельности для обеспечения себя и членов своей семьи. Если же исходя из особенностей дела и личности обвиняемого его необходимо лишить права на свободу передвижения практически на целый день с предоставлением 1-2 часов прогулки для посещения магазина, аптеки, это должно оформляться домашним арестом.

В-четвертых, проблемой является расширительное толкование судьями своих полномочий по наложению запретов. Недопустимо применение запретов, не предусмотренных ч. 6 ст. 105.1 УПК РФ.

PROBLEMS OF LEGAL REGULATION AND THE PRACTICE OF APPLICATION OF THE PROHIBITION TO GO OUTSIDE THE RESIDENTIAL PREMISES WHEN CHOSING THE PROHIBITION OF CERTAIN ACTIONS IN THE CRIMINAL PROCEDURE

The article deals with a number of topical problems of applying the prohibition to go outside the premises when choosing a measure of restraint in the form of a prohibition of certain actions (clause 1, part 6, article 105.1 of the Criminal Procedure Code of the Russian Federation).

Firstly, the criminal procedure legislation and the Plenum of the Supreme Court of the Russian Federation do not define the concept of «residential premises», in relation to the measure of restraint in the form of a prohibition of certain actions. In this case, by analogy, it is necessary to apply the concept enshrined in Part 2 of Art. 15 of the Housing Code of the Russian Federation.

Secondly, the problem of law enforcement is the absence in almost all court decisions of any justification for establishing specific deadlines for the prohibition to leave the premises. The revealed gaps in the motivation of the decision to prohibition of certain actions indicate that there are no real grounds for restricting the defendant’s constitutional right to freedom of movement in these cases.

Thirdly, there are no norms of legislation and clarifications of the Plenum of the Supreme Court of the Russian Federation on the issue of the minimum duration of the period of free movement of a person who is under a measure of restraint in the form of a prohibition of certain actions. In the absence of such norms, some judges consider it possible to almost completely restrict the freedom of movement of the accused, leaving 1-2 hours for going to shops and for a walk, which, in fact, taking into account established practice, equates this measure of restraint with house arrest. We propose in the Resolution of the Plenum of the Supreme Court to distinguish between these preventive measures, establishing that when certain actions are prohibited, the ban on freedom of movement can be limited to night time or another period of no more than 14 hours a day, and at the same time, the accused must retain the opportunity to work to provide for himself and members of his family. If, based on the characteristics of the case and the personality of the accused, it is necessary to deprive him of the right to freedom of movement for almost the whole day with the provision of 1-2 hours of walking to visit a store, pharmacy, this should be formalized by house arrest.

Fourthly, a problem is the broad interpretation by judges of their powers to impose bans. It is unacceptable to apply prohibitions that are not provided for in Part 6 of Art. 105.1 of the Code of Criminal Procedure of the Russian Federation.
